On Friday, the Cincinnati-based 6th Circuit U.S. Court of Appeals declined to overturn a previous ruling from a federal judge in Detroit who agreed with both Michigan Secretary of State Jocelyn Benson and the Michigan Supreme Court that it was too late to have Kennedy's name removed from the state's presidential ballot.

The candidate had asked the justices to intervene after a state judge found that he had used an improper home address in election paperwork.

The decision came after more than 418,000 absentee ballots have already been sent to voters. As of Thursday, nearly 28,000 had been returned, according to the Wisconsin Elections Commission.
